Site Terms of Use

Use and Registration

As a visitor (“you”, “your”) of Guhuza’s (“Guhuza”, “we”, “our”) site, or that of one of its affiliates, you will access information, such as text, images, listings, digital media, etc. (“Site Content”). As Guhuza does not warrant the accuracy or completeness of the Site Content, this site may contain inaccuracies or errors. Guhuza may change or update this site without notice. 

Guhuza is not a job board, it is a hiring platform. You do not search and apply for a job. We are constantly looking for jobs that match your profile. Accordingly, as a job seeker, when you register with Guhuza, you will be asked to provide certain information, including, but not limited to, your e-mail address, mobile number, job title, skills and employment history to find a good match (“Candidate Information”). As a Guhuza user, the more complete your profile, the better we will be able to match you with your ideal employer. 

You acknowledge that by registering as a job seeker with Guhuza, you expressly consent to receiving e-mail and SMS messages from us and our registered employers. You may choose not to provide us consent or revoke your consent, in which case you will not be able to make use of our service. 

To ensure a good match, you acknowledge and agree that Guhuza will share Candidate Information with potential employers. Guhuza may share Candidate Information with partners and third parties to facilitate the interviewing and hiring process, such as background checking agencies and skills-assessment companies. When you are matched and receive an interview offer, the interview may be via live recorded video on Guhuza. You acknowledge and agree to act professionally and in a dignified manner, at all times with Guhuza employers, and recognize that Guhuza is not responsible for an employer’s actions whilst using Guhuza or making offers through Guhuza.

In providing you an employer match, our automated decision-making system processes your Candidate Information to align with the needs of potential employers, and to provide the highest scoring candidates to the employer. In doing so, Guhuza respects your rights and has a progressive policy on diversity and inclusion. Accordingly, our automated decision-making system is designed in an ethical manner to mitigate bias in the matching and selection process. 

Our collection, use and disclosure of Candidate Information is governed by our Privacy Policy.

You may, at any time, update or delete your Candidate Information. If you encounter issues, please contact us at support@guhuza.com.

Right to Use Your Information

In addition to the Candidate Information, and except as set out in our Privacy Policy or as required by applicable law, you expressly acknowledge and agree that anything you send to us electronically, either directly or through our site, such as comments or product recommendations (“Submitted Information”), are not proprietary to you. Specifically, you waive your moral rights to the Submitted Information, and grant Guhuza a perpetual, royalty-free, fully paid licence to use the Submitted Information for any purpose, including developing and marketing new products and services.

Notwithstanding the foregoing, Guhuza may make recordings of video interviews available to an employer in accordance with applicable law. 

Use of Marks

The Site Content contains certain names, words, phrases, domain names, logos, graphics and designs that are Guhuza’s property, including trade names or trade-marks for Guhuza and its related companies or its licensors (“Trade-marks”). Unless you have a separate agreement with us, you are not granted a licence of any kind to the Site Content or Trade-marks. Registering as a candidate does not grant you a licence to use the Site Content or Trade-marks. Copying, modification, or re-transmission of the Site Content or Trade-marks may be a violation of Guhuza’s rights and federal law, for which you could be liable. The Site Content and Trade-marks on this website are protected under the copyright and trade-mark laws of Canada and other countries.

Prohibited Actions

This site includes functionality that allows you to enter, upload and transmit content. To ensure the protection of other Guhuzians, you agree to use this site in compliance with applicable law and Guhuza rules of use. In your use of this site, you specifically acknowledge and agree that you are strictly prohibited from taking the any of the actions listed below (collectively, “Illegal Actions”):

  • loading, transmitting, distributing, or storing material or information in violation of any applicable law or regulation
  • loading, transmitting, distributing, or storing material or information protected by copyright, trade-mark, trade secret or other intellectual property right used without proper authorization
  • loading, transmitting, distributing, posting or storing material or information that is obscene, defamatory, constitutes an illegal threat, violates export control laws, or contains language that is not, in Guhuza’s sole discretion, dignified or professional
  • using any device, software or routine to interfere or attempt to interfere with the operation or performance of the site
  • monitoring data or traffic on any network or system without express prior written authorization from Guhuza
  • interfering with service to any user, host or network including, mailbombing, flooding, deliberate attempts to overload a system and broadcast attacks
  • forging any TCP-IP packet header or any part of the header information in an e-mail
  • sending unsolicited mail or electronic messages
  • distributing spam, chain letters, or pyramid schemes
  • taking any action that imposes, or may impose (in Guhuza’s sole discretion) an unreasonable load on Guhuza’s infrastructure
  • accessing or using data, systems or networks to attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express prior written authorization from Guhuza
  • facilitating any viruses, Trojan horses, worms or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any user's information or Guhuza’s infrastructure
  • taking any action that may cause us to lose any of the services from our internet service providers or other suppliers
  • posting any incomplete, false, misleading or inaccurate biographical information or information which is not your own accurate resume 
  • promoting any type of product or service, including recruiting services, job boards and financial product

If we discover you have committed, or are committing, an Illegal Action, we may suspend or terminate your access, pursue legal action to stop or minimize the impact of your Illegal Action, and, to the extent permitted by law, you waive all of your defences against any action by Guhuza to stop or limit any Illegal Action.

Disclaimer and Limitation of Liability

Guhuza is not liable for agreements between you and a Guhuza employer, even if we receive a fee for the transaction. 

Guhuza shall not be liable to you for any loss of money, goodwill, or reputation, direct, indirect, incidental, special, punitive or other consequential damages for your use of this site, third party services or third party links, including, but not limited to, loss of programs or other data on your computer system, even if we are advised of the possibility of these damages. The Site content is provided “as is”. All warranties and conditions are disclaimed, including the implied warranties and conditions of merchantability or fitness for a particular purpose.

You indemnify Guhuza, its officers, directors, agents, subsidiaries, and employees (“Guhuza Agents”), from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms of Use, including claims arising as a result of your Illegal Action. You further indemnify Guhuza Agents against any claims regarding your employment, offers, or employer conduct during an interview with an employer matched through Guhuza.

Third Party Websites

The Site may contain links to unaffiliated third parties. We are not responsible for the terms of use for third party sites. 

Governing Law and Jurisdiction

This site is controlled by Guhuza from servers located in Canada. By accessing this site, you agree that all claims relating to your use of, or access to, this site, shall be governed by the laws of the Province of Ontario and applicable federal law, without regard to its conflicts of law principals. You also agree and submit voluntarily to the exclusive jurisdiction and venue of the courts sitting in the Mississauga, Ontario.
